The Ministry of Labor introduced the new rules on May 22 and they
quietly came into force in Phuket on July 1.
There are two tiers of work permit. Applications by those who apply
under any one of the five qualifications listed in the first tier will
be checked by the Employment Services Office (ESO). From application
to issue of work permit (or denial) takes seven working days,
according to the ESO.
In Phuket, applications by those who apply under any one of the 12
qualifications listed in the second tier will be checked by the Work
Permit Committee, chaired by Vice Governor Manit Wattanasen.
It should be noted that no official English-language translation is
yet available. The translation below was done by the Gazettes own
staff. It should also be noted that the rules are still undergoing a
shake-out period during which definitions of various terms will be
refined.
The new rules supercede all previous regulations. All applications
must be submitted to the ESO.
The first tier qualifications are:
* The foreigner works in a business with a paid-up capital and
start-up capital of not less than 2 million baht. The company may
apply for one work permit for every 2 million baht capital, up to a
maximum of 10 working foreigners.
* The foreigner works in a business that has paid income tax to the
government over the past three years totaling not less than 5 million
baht. This business may have one working foreigner.
* The foreigner works in a business that exports products and brought
foreign currency amounting to at least 3 million baht into Thailand in
the most recent year. Such a business is allowed to have one working
foreigner for every 3 million baht up to a maximum of three working
foreigners.
* The foreigner works in a business that employs at least 50 Thai
employees. This company may have one working foreigner per 50 Thai
employees up to a maximum of five working foreigners.
* The foreigner has an income and has paid annual personal income tax
to the Thai government of at least 18,000 baht over the past few years
or in the most recent tax year.
In cases where an application is turned down, the ESO is obliged to
provide the applicant with a letter explaining why it was denied.
The applicant may then lodge an appeal, via the ESO, which must pass
it on to an Appeals Committee in Bangkok within 15 days. The committee
must consider the appeal and deliver its opinion to the Minister of
Labor within a further 15 days. The Minister must deliver his decision
within 30 days.
The 12 second-tier qualifications are:
* The foreigner represents an international company and enters
Thailand to check product standards or to purchase products or to
conduct a study of the status of the market.
* The foreigner acts periodically as a consultant in investment, or
management, or techniques and technology, or internal audit.
* The foreigner is a representative of a tourism business who brings
foreigners to visit Thailand.
* The foreigner represents an international financial institution that
is approved by a relevant Thai government department.
* The foreigner is employed in an activity, entertainment, amusement,
music, religion, social welfare, cultural activity or sport which by
its nature is temporary employment and non-profit-making, or creates
income for Thailand, or benefits society.
* The foreigner is brought to Thailand to complete a project of a
government department or a state enterprise.
* The foreigner is engaged in work that uses mostly domestic material
or reduces the importation of material from overseas.
* The foreigners work supports the export of Thai products.
* The foreigner does work that brings in technology that Thailand does
not yet use, and publicizes and transfers the technology to Thais.
* The foreigner does work that a Thai can do but in a case where there
is insufficient supply in the domestic labor market to meet the
employers needs.
* The foreigner is resident in Thailand and has a residence
certificate or an alien identification card.
* The foreigner is the spouse of a Thai person, has a legally
registered marriage certificate and openly cohabits with his or her
spouse as husband and wife, and has a legal occupation.
