    The Constitution Tribunal ruled Wednesday that the Democrat Party had not breached the MPs and Senatorial Election Act because the act had lapsed after the coup.

    The Constitution Tribunal ruled Wednesday that the Democrat Party had not breached the MPs and Senatorial Election Act because the act had lapsed after the coup.

    The ruling was the first of four points of legal considerations related to the case of the Democrat.

    Reading the legal interpretations before the verdict, Judge Somchai said the organic election had not been exempted by any coup order so it was annulled by the coup.

    But the Democrat lost in the second, third and fourth points of legal disputes.

    In the second point of judicial reviews, the tribunal ruled that the suit against the Democrat was legitimate because the party was not given enough time and the election commission did not rush to file charges against the party as claimed by the Democrat.

    In the third point of review, the tribunal ruled that EC chairman had filed the suit against the Democrat in line with the party law.

    In the fourth point of disputes, the tribunal ruled that the suit was still legitimate although the election was annulled because the alleged crime had already committed.

    The tribunal is still reading other verdicts.

    sowie es momentan aussieht - wird die TRT aufgelöst und die
    demokr. Partei bleibt bestehen.

    Dann wären ja die Chancen für Abbhasit recht gut, nächster Prem zu werden

    Und das ist jetzt auch der Endstand. Zusätzlich sind noch die Pattana Chart Thai,Thai Ground und die Progressive Democratic Party wegen Verstößen aufgelöst worden. Den MPs von TRT wie auch den Vorsitzenden der kleinen Parteien ist außerdem für 5 Jahre das passive Wahlrecht entzogen.

    The Constitution Tribunal judges wound up a day-long reading of their verdict in the political parties case late on Wednesday night, by ordering the powerful Thai Rak Thai Party of ex-premier Thaksin Shinawatra dissolved for election cheating - and banning 111 top members from political life for five years.
    The nine judges also found two Thai Rak Thai executive committee members guilty of illegally hiring small parties in the April, 2006, election - Gen Thammarak Issarangkura na Ayudhya and Pongsak Raktapongpaisarn.
    The order disbanding Thai Rak Thai contrasted with the earlier decision to allow the Democrat Party and its executives to continue in politics.
    Thai Rak Thai leader Chaturon Chaisaeng, who took over after Mr Thaksin went into self-exile after last year´s coup, sat on the edge of his seat during most of a late-night verdict, which ended not long before midnight.

    Mr Chaturon said he was "not worried for myself, but I worry about the country." He had pledged to accept the Tribunal´s verdict, which cannot be appealed.

    Judges said that disbanding a political party was a serious matter.

    Thai Rak Thai won elections in 2001 and 2005, they said, and had 14 million members. Ordering the party dissolved would cause economic problems.

    But the verdict laid much of the blame for shaky Thai Rak Thai political deals on the back of founder and then-leader Thaksin Shinawatra, still in foreign exile. The judges said Mr Thaksin had used the party for his own benefit, and Thai Rak Thai had no political ideology beyond its leader´s ambitions.
    The immediate fate of Thai Rak Thai, the country´s most popular party, was not known.
    But Mr Chaturon and other executives could immediately apply to form a "new" party, perhaps even using the Thai Rak Thai name.
    Worries of violence after the verdict had long faded by the time the announcement against the party was made. But even at the height of public interest on Wednesday afternoon, no more than a few hundred peaceful supporters of both parties were gathered in three spots in Bangkok - at the court and at the two parties´ headquarters.

    The government had amassed a security force of 13,000, none of whom was needed to keep order.

    A huge media corps of 700 outnumbered all political supporters from all factions.

    "The facts cannot prove that the Democrats did any wrongdoing so there is no reason to dissolve the Democrats," said Thanit Kesawapitak, one of nine judges on the Constitutional Tribunal that examined charges against the party.

    The Democrats were accused of hiring smaller parties to obstruct the April 2, 2006, general election and of defaming Thai Rak Thai, founded and led at the time by prime minister Thaksin Shinawatra, who was ousted in the military coup more than five months later.
    "This was a fair verdict, and a good development for the people," said former Democrat Party leader Banyat Bantatan. The Democrat Party, which faced dissolution if found guilty, is Thailand´s oldest political party, celebrating its 61st anniversary this year.
    The Democat party leader Abhisit Vejjajiva and ex-party leader Chuan Leekpai entered the courtroom at around 1 p.m. to wait for the verdict. [....]
    The final verdict was handed out at around 5.30 p.m., although details came out late in the verdict reading.
    On the small Prachatippatai Kao Na (Progressive Democratic ) party, the tribunal ruled that it was guilty of election cheating. The decision was an anti-climax since it is a tiny party, virtually unknown before being thrown into the legal ring with the two biggest parties in the country.

    Its nine executive party members are forbidden from running for political office for five years.

    Die Entscheidung des Verfaasungsgerichts ist sehr zu begrüssen und ein wichtiger Meilenstein auf dem Weg Thailands zu Demokratie.

    die Democratic Party dürfte wohl nun stärkste Partei werden, da es keine alternative Großpartei mehr gibt und die Gegenstimmen sich daher auf viele Klein-Parteien aufteilen werden.
    Bei einem Sieg der DP wäre dann Abhasit mit Sicherheit nächster Prem.

    Stimmung ist hier, in meiner Strasse, recht ausgelassen. Vom Motorradfahrer bis zu meinen Kollegen, sind viele recht froh, dass ein Entscheidung gefallen ist. Die meisten begruessen auch den Ausgang.
